Terms of Service

These terms are the agreement between you and Peakloom when you use our website or the Peakloom app. We've kept them as short and as human as a legal document allows.

Accepting these terms

By joining the waitlist, visiting peakloom.com or using the Peakloom app, you agree to these terms. If you don't agree with something here, please don't use the service - or better, email us first; maybe we can fix it.

The service

Peakloom is a photo editor for macOS, currently in pre-release. Joining the waitlist gives you no guarantee of access, pricing or launch date. Features shown on this site describe what we're building; they may change, be renamed or be removed before or after launch.

Your account

You can use much of Peakloom without an account. If you create one, sign-in works via a one-time magic link sent to your email - keep access to that inbox secure, because anyone who controls it controls your account. Your plan may limit the number of devices signed in at once; you can manage and remove devices in your account settings.

License

We grant you a personal, non-exclusive, non-transferable license to install and use the Peakloom app on devices you own or control, in line with these terms and your plan. You may not copy, modify, resell, sublicense, reverse-engineer or redistribute the app, or bypass its licensing and feature gates, except where the law explicitly allows it.

Your content

Your photos and projects are yours. Peakloom claims no ownership over anything you create or edit with it, including work made with AI assistance, and you're free to use your results commercially.

In return, you're responsible for the content you edit: make sure you have the rights to the images you bring in, and that what you create doesn't violate the law or other people's rights.

When you use a cloud AI feature, you give us permission to process the submitted image data for the sole purpose of fulfilling that request, as described in our Privacy Policy.

Acceptable use

Don't use Peakloom to create or process:

  • Content that is illegal in your jurisdiction or ours;
  • Sexual content involving minors - this results in an immediate, permanent ban and a report to the authorities;
  • Non-consensual intimate imagery, or edits intended to harass, defame or deceive - including presenting AI-manipulated images of real people as authentic;
  • Attempts to probe, overload or abuse our servers, quotas or AI endpoints.

Purchases and subscriptions

Some features require a paid plan. Prices are shown before you buy, billing is handled by our payment processor, and subscriptions renew automatically until cancelled - you can cancel anytime, effective at the end of the paid period. If we change prices, we'll tell you before your next renewal. Refunds follow our payment processor's policy and applicable consumer law. On the free tier, exports may carry a Peakloom watermark.

Updates and availability

The app updates itself to keep you on the latest version. We may add, change or remove features, and we may suspend or discontinue parts of the service (particularly cloud features) with reasonable notice where possible. Peakloom is pre-release software: expect rough edges, and keep backups of work that matters.

Disclaimer of warranties

Peakloom is provided "as is" and "as available", without warranties of any kind, express or implied - including merchantability, fitness for a particular purpose and non-infringement.

Limitation of liability

To the maximum extent permitted by law, Peakloom and its team are not liable for indirect, incidental, special or consequential damages, or for loss of data, profits or goodwill, arising from your use of the service. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim - or, if you paid nothing, to zero. Nothing in these terms limits liability that cannot legally be limited.

Termination

You can stop using Peakloom and delete your account at any time. We may suspend or terminate access if you materially breach these terms - for acceptable-use violations, immediately. Sections that by their nature should survive (your ownership of your content, disclaimers, liability limits) survive termination.

Changes and governing law

We may update these terms as Peakloom evolves; the date at the top reflects the latest version, and material changes will be announced by email or in the app. Continued use after a change means you accept it.

These terms are governed by the laws of the jurisdiction where Peakloom's operating entity is established; we will name that entity and the competent courts here before commercial launch.
